ANNEX 2 - CONDITIONS IMPOSED IN ACCORDANCE WITH THE OPERATING SCHEDULE
The licence holder and/or the designated premises supervisor or a person nominated by them shall be a member of and regularly attend at the meetings of the Pub and Club Watch schemes for the area within which the premises is located.
Only glasses made of ‘toughened glass’ will be used whether alcohol is being consumed on the premises, or in any area outside the premises, which trades as part of the premises where such toughened glass is commercially available.
The licence holder shall use a radio link / pager connected to the town centre radio scheme and other licensed premises whilst such a scheme is in existence
A CCTV system shall be operated at the premises, internally, externally and on the entrances to the premises to the satisfaction of Lancashire Constabulary and shall be used to record during all hours that the premises are open to the public.
The images recorded by the CCTV system shall be retained in unedited form for a period of not less than 31 days or other lesser period agreed with the Divisional Police Licensing Officer, Lancashire Constabulary
There shall be a maximum capacity at the premises including staff and entertainers of 575 persons distributed with a maximum of 220 on the 1st floor of the premises.
There shall be no irresponsible drinks promotions which would contravene the British Beer and Pub Association Code of Practice on Point of Sales Promotions
The 'safer clubbing' guide shall be adopted as best practice
All members of staff concerned in the sale of alcohol shall receive training in relation to under age sale prevention
Persons who appear to be under the age of 21 years shall be required to produce proof of age by way of one of the following:
- A recognised proof of age card accredited under the British Retail Consortiums Proof of Age Standards Scheme (PASS)
- Photo driving licence
- Passport
- Citizen card supported by the Home Office
- Official ID card issued by HM Forces or European Union bearing a photograph and birth of the holder
There shall be a zero tolerance drugs policy in operation referred to in Paragraph 7.61 to 7.64 Statutory Guidance to the Act and Safer Clubbing publication
Before the premises are opened for the purposes authorised by the licence an inspection shall be carried out to ensure that the premises are safe for use. Details of the inspection, defects discovered and remedial action taken shall be recorded in writing in a logbook kept for that purpose. That logbook shall be made available for inspection on demand to an Authorised Officer of the Council, a Fire Officer or a Police Constable.
Sales of alcohol for consumption off the premises shall cease at 2300 hours with the exception of staff members who may purchase alcohol for consumption off the premises at the end of their shift should it end after 2300 hours.
There shall be provided at the premises door supervisors who are registered with the Security Industry Authority to such a number as the management of the premises consider are sufficient to control the entry of persons to the premises, and for the keeping of order in the premises when they are used for a licensable activity, but the minimum number of doorstaff shall be :
A. At all times
3 for the first 150 patrons and 1 additional member of doorstaff for each subsequent 100 patrons or part thereof, and there shall be a minimum of
B. Friday
between 2200 hours and 0030 hours - 3 supervisors
between 0030 hours and the terminal time that the premises are open to the public
- 5 supervisors
C. Saturday
between 2200 hours and 2330 hours - 3 supervisors
between 2330 hours and 0030 hours - 5 supervisors
between 0030 hours and the terminal time that the premises are open to the public
- 7 supervisors
however, the numbers of supervisors referred to above may be reduced if there are insufficient numbers of patrons in the premises, but shall not be reduced to a level below A Above at any time.
Door supervisors shall operate throughout the premises to perform their role and shall not be restricted to being present on the door only.
At all times when the premises are used for a licensable activity, the licence holder or designated premises supervisor shall either themselves or by nomination of duties to a third party, be aware of the number of persons present on the premises at any one time by use of entry and exit counting devices or other electronic means, and if requested to do so, shall provide that information to an authorised officer.
All exits at Annex 4 and escape routes to those exits (including external escape routes) from the premises shall be maintained in good repair, correct working order and kept free from all obstructions and shall be available for immediate use when the public are on the premises.
There shall be a specific written evacuation procedure for disabled customers in place and staff shall receive training in relation to that procedure.
There shall be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials.
All electrical systems concerned with emergency lighting, fire alarm, electrical and gas installations shall be checked by a competent engineer at yearly or 5 yearly intervals or at such intervals required by the appropriate British Standard
There shall be a fire risk assessment completed in relation to the premises
There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public, notices requiring customers to leave the premises and the area quietly, and these shall be supplemented by door supervisors asking people to leave quietly.
Door supervisors shall moniter those customers queuing to gain entry to the premises and shall use approved management methods in relation to any person causing a disturbance, including refusal of adnmission to such persons where appropriate
Signage shall be placed outside the premises advising customers that any person causing a disturbance will be refused admission
Persons who persistently cause a disturbance outside the premises either before entry or upon egress shall be banned from the premises in accordance with management practice and procedure.
Door supervisors shall not allow patrons to leave the premises with open or unsealed containers, bottles or glasses
Door supervisors shall ensure people leaving the premises disperse and do not congregate on or near the premises
The grounds of the premises shall be kept tidy and shall not be the cause of nuisance
A noise limiter shall be installed, maintained, used and set at a level in accordance with Condition 7 of the Planning Permission granted to the premises.
Any Section 34(5)(e) Gaming Act 1968 or Category C Gambling Act 2005 machine shall be sited within view of the bar or area maintained for the sale of alcohol
No person under the age of 18 years shall be allowed to enter or remain on the premises at any time when licensable activity is taking place, unless to a function to which the general public are not admitted. Should such a person be admitted under these conditions, they must be accompanied and supervised by a person of at least 18 years of age and they shall not be admitted to any are of the premises where the management deem it inappropriate for the promotion of the licensing objective.
No person under the age of 18 years shall remain on the premises after 2200 hours in any circumstances.
