ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE OR IMPOSED UNDER PARAGRAPH 6(6) OR 6(8) SCHEDULE 8 LICENSING ACT 2003
Alcohol shall not be sold or supplied except during permitted hours. In this condition, permitted hours means between :
1100 and 2400 hours Monday to Thursday
1100 and 0130 hours Friday and Saturday
1200 and 0000 hours Sunday
the terminal time for the sale of alcohol on 31st December until 0200 hours on 2nd January
1100 and 0130 hours on 24th and 26th December and St. Georges Day
The above restrictions do not prohibit:
(b) during the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
(c) consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
(d) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
(e) the sale of alcohol to a trader or club for the purposes of the trade or club;
(f) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
(g) the taking of alcohol from the premises by a person residing there; or
(h) the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
(i) the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
Where there is an entertainment for children or an entertainment at which the majority of the persons attending are children, then if the number of children attending the entertainment exceeds 100 it shall be the duty of the person providing the entertainment to station and keep stationed wherever necessary a sufficient number of adult attendants, properly instructed as to their duties, to prevent more children or other persons being admitted to the building, or part thereof, than the building or part can properly accommodate, and to control the movement of the children and other persons admitted while entering and leaving the building or an part thereof, and to take all reasonable precautions for the safety of the children.
The premises licence holder or club premises certificate holder when permitting for hire or reward, the building to be used for the purpose of an entertainment, shall take all reasonable steps to ensure the observance of the provision of the above provision.
No child shall be employed so long as he/she is under the age of 14 years to do any work other than light work or before the close of school hours on any day on which he/she is required to attend school or before 7 o’clock in the morning or after 7 o’clock in the evening on any day or for more than 2 hours on any day on which he/she is required to attend school or for more than 2 hours on a Sunday or more than 35 hours, or if he/she is under the age of 15 years, for more than 25 hours in any week in which he/she is not required to attend school or for more than 4 hours in any day without a rest break of 1 hour or at any time in a year unless at that time he or she has had, or could still have, during the period in the year in which he is not required to attend school, at least two consecutive weeks without employment.
No person under the age of 16 years and no child aged 16 years shall take part in any performance to which Section 37 (2) of the Children and Young Persons Act 1963 applies, and in which his life or limbs are endangered.
The licence holder and/or the designated premises supervisor or a person nominated by them shall be a member of and regularly attend at the meetings of the Pub Watch scheme for the area within which the premises is located.
Only glasses made of ‘toughened glass’ will be used whether alcohol is being consumed on the premises, or in any area outside the premises, which trades as part of the premises wherever possible.
All drinks sold in bottles will be sold in non-glass bottles wherever such products can be supplied in plastic or non-glass bottles by the manufacturer.
There shall be a zero tolerance drugs policy to at least the minimum standard of the Safer Clubbing referred to in the Licensing Act 2003 Statutory Guidance Section 7. 61
The premises will be voluntarily closed when requested by the police and during specific times on the occasion of local football matches
There shall be no irresponsible sales promotion which would contravene the British Beer and Pub Association code of practice on point of sales promotion.
All members of staff involved in the sale of alcohol shall receive training in the prevention of sales to under age persons to the standard of the British Intitute of Innkeeping
The grounds of the premises will be kept tidy to prevent public nuisance.
Windows will be kept closed when any licensable activities are taking place to prevent noise pollution unless in an emergency
All external lighting and signage will be turned off at 2300 hours
There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public, notices requiring customers to leave the premises and the area quietly and respect local residents.
Any person who persistently causes problems in the vicinity of the premises shall be banned from the premises
The beer garden and any other external area on Annex 4 shall be closed to customers at 11pm except for the purposes of access and egress to motor vehicles on the car park.
There shall be no admission or re-admission of the public to the premises within the last hour permitted for the sale of alcohol on any day
No person under the age of 18 years shall be admitted to the premises at any time when activities of an adult nature are taking place
No person under the age of 16 years shall be admitted to or remain in the premises after 2000 hours on any day
No person of 16 years or older but under 18 years of age shall be admitted to or be allowed to remain in the premises after 2000 hours on any day unless accompanied by a person of 18 years of age or older.
