Conditions of Licence
Part 1 - GENERAL
DIVISION INTO PARTS
1. These Conditions are divided into parts as follows:-
Part 1 General
Part 2 Conditions which apply to all premises
Part 3 Additional Conditions for premises used for stage presentations
Part 4 Outdoor Licensing Conditions
DEFINITIONS
2. In these Conditions unless the context otherwise requires:-
“Licensing Authority” means Hyndburn Borough Council.
“Normal or General Lighting” means all lighting other than emergency or safety lighting permanently installed in those parts of the premises to which the public have access. The term may include purely decorative lighting but not lighting installed solely for advertising purposes.
“Emergency or Safety Lighting” means lighting obtained from a source independent of the normal or general supply for the building provided to assist the public, performers and staff to leave the premises without the aid of the normal or general lighting.
“Platform” means that part of the public assembly space which is arranged for the accommodation of performers and which is not a stage.
“Stage” means that part of the building associated with a hall or auditorium which is constructed or arranged for the performance of plays or similar entertainments.
“Stage Area” means the stage, together with any stage basement and any scene dock, workshop, staff room, store or other parts ancillary to it.
“Premises” means a place, an enclosure, a building or that part of a building used for public assembly and all other buildings within a place containing services or installations used in connection with the assembly.
“Suitable Plan” means a legible scale drawing of the premises preferably at a scale of 1:100 (metric).
“Place of Safety” means a place in which persons are in no danger from fire.
“Fire Resistance” means the ability of an element of building construction to satisfy for a stated period of time the criteria specified in British Standard 476: Part 8 namely resistance to collapse, resistance to flame penetrating and resistance to excessive temperature rise on the unexposed face.
“Surface Spread of Flame” means material used for wall and ceiling linings, acoustic or thermal insulation linings should normally be non-combustible or be rated Class 1 for surface spread of flame when tested in accordance with the appropriate provisions of British Standard 476: Part 7: 1971. Class 1 and Class 0 shall be as prescribed by the current Building Regulations/British Standards.
‘’Door Supervisor” means any person (other than the licensee) involved in the regulation and control of admissions to premises holding a Justice’s On Licence and a Public Entertainment Licence and shall include all persons involved in the safety and control of customers attending these premises, whether admitted or not.
LICENSEE
3. Shall, in the case of a Cinematograph Licence include, where the context so admits the owner of the cinematograph or other apparatus, the occupier of the Licenced premises, the responsible person nominated in writing by the Licensee to be in charge of the premises in pursuance of the Regulations of the Secretary of State and any other person who is for the time being in charge of the premises.
DISPENSATION OR MODIFICATION OR CONDITIONS
4. These conditions may be dispensed with or modified by the Licensing Authority in any special case.
PART 2 - CONDITIONS WHICH APPLY TO ALL PREMISES
LICENCE TO BE KEPT ON PREMISES
1. This licence must be kept on the Licenced premises and must be accessible to the Licensee and produced on demand to any duly authorised person.
HOURS OF OPENING AND CLOSING
2.(a) The Licenced premises shall not be opened for the purpose for which this licence is granted otherwise than in accordance with the permitted opening times specified in the licence save that on the evening of 31st December/1st January the permitted hours shall be the same as those allowed for the sale of alcohol on the premises;
(b) On Christmas Day the Licenced premises shall not be opened for the purpose for which this licence is granted except with the permission of the Licensing Authority;
(c) Extension of these hours may be given by written permission of the Licensing Authority.
(d) The Licenced premises shall not be open for the purpose for which this licence is granted on any occasion such as days of national thanksgiving or outbreaks of contagious disease when the Licensing Authority may signify their desire in writing to the occupier or other person having at the time the care and management of the premises that the same should not be open.
PLANS
3. At the time of application for grant or transfer of Entertainments Licence a suitable plan of the premises shall be provided together with such other information deemed necessary by the Licensing Authority.
CHANGE OF LICENCED PREMISES AND ATTENDANTS
4. The Licensee or a responsible person nominated by him in writing for the purpose shall be present and in charge of the premises during the whole of the time that they are open to the public. During that time there shall be on duty in the premises such number of attendants as may be required by the Licensing Authority and as laid down in the Schedule attached to these conditions. The attendant or attendants with primary responsibility for ensuring that the public leave the premises safely in the event of an emergency shall be not less than eighteen years of age.
MAINTENANCE OF ORDER
5. The Licensee shall be under a duty to maintain good order, conduct and decency on the premises.
5(a) It is the licensee’s duty to ensure that any person employed as a door supervisor shall be registered under the Council’s Door Supervisor Registration Scheme, and to comply in all respects with the requirements of that Scheme.
HYPNOTISM
6. No person shall give at the premises (otherwise than as provided by Section 5 of the Hypnotism Act 1952) any exhibition, demonstration or performance of hypnotism, mesmerism or any similar act or process which produces or is intended to produce in any other person any form of induced sleep or trance in which the susceptibility of the mind of that person to suggestion or direction is increased or intended to be increased.
GAMING
7. No gaming shall be permitted on the premises except in accordance with a licence granted under the Gaming Act 1968.
OVERCROWDING
The number of persons allowed in any area Licenced for entertainment shall be limited to keep within the occupancy figure laid down by the Licensing Authority.
Overcrowding in such a manner as to cause danger to any person shall not be permitted in any part of the premises.
MAINTENANCE OF PREMISES
9. All parts of the premises, services and fittings therein, including the seating, door fastenings and notices, shall be maintained at all times in good order and condition.
MEANS OF ESCAPE IN CASE OF FIRE
10. (a) The premises shall be provided with such means of escape in case of fire for all persons resorting thereto as may reasonably be required in the circumstances of the case;
(b) All such means (including external escape routes to a place of safety) approved by the Licensing Authority shall be properly maintained in an efficient state, in efficient working order, in good repair and shall be kept free from obstruction at all times when the premises are occupied;
(c) Fire resisting doors fitted with self closing devices, other than approved automatic releases shall be maintained positively self closing at all times and shall not be provided with any means of keeping them in the open position;
(d) Fire resisting doors fitted with self closing devices and approved automatic releases shall not be provided with any other means of keeping them in the open position;
(e) All doors through which a person may have to pass shall be maintained freely available for exit purposes and shall be fitted only with approved fastenings which are easily and immediately operable, without recourse to the use of a key, by any person leaving the premises in the event of an emergency. Fastenings other than automatic panic bolts shall be made inoperative whilst the public are present on the premises. The method of operating any such fastening shall be displayed conspicously above the fastening in accordance with the Health and Safety (Signs and Signals) Regulations 1996. The words shall be displayed in white block lettering on a green background. All exit doors shall open outwards and be clear of any steps. Any doors which do not open outwards shall be locked back in the open position throughout the time the public are present.
(f) All escape routes, including stairways and steps, comprising the means of escape in case of emergency shall be maintained with non slippery and even surfaces;
(g) All stairs and floor coverings, mats, etc., shall be secured and maintained so that they will not in any way be a source of danger to persons’ escape in case of emergency;
(h) All floors, walls and ceilings shall be kept in a satisfactory state of repair. All wall and ceiling linings shall be to the satisfaction of the Licensing Authority. In general all wall and ceiling linings on exit routes shall be treated to achieve Class “O” resistance to surface spread of flame and to general areas Class “1”;
(i) Any door off the auditorium or exit ways which does not lead to an exit shall be subject to such conditions as the Licensing Authority may direct;
(j) Any barrier or temporary barrier shall not be erected or installed without the prior approval of the Licensing Authority;
(k) When so required by the Licensing Authority diagrammatic plans showing escape routes shall be publicly displayed, where necessary, these shall be supplemented by prominently displayed directional signs showing the routes to be taken to emergency exits;
(l) (i) No fastenings other than automatic bolts shall be fitted on exit doors used by the public which shall be of such pattern and in such positions as the Licensing Authority may determine; Automatic bolts shall be of such a pattern that horizontal pressure on the cross bars will open the doors;
(ii) If the Licensing Authority give consent to the use of chains, padlocks or other devices for securing exit doors when the public are not on the premises a responsible person shall be required to remove such chains, padlocks, or other devices before the admission of the public and such chains, padlocks or other devices shall not be replaced during the whole time the public are present in the Licenced premises;
Such padlocks and chains shall be placed on a specially prepared notice board in a prominent position, that can be easily seen by the Licensee. There shall be a hook to receive each padlock and chain being numbered with corresponding number on the appropriate door(s).
The specially prepared notice board shall have the following “NOTICE” to read in 16 mm. block letters.
“THE PADLOCKS AND CHAINS FITTED TO EXIT AND ENTRANCE DOORS FOR SECURITY PURPOSES ARE TO BE REMOVED FROM THE DOORS AND PLACED ON THIS BOARD PRIOR TO THE PUBLIC BEING ADMITTED. THESE PADLOCKS AND CHAINS MUST NOT BE REPLACED ON THE DOORS UNTIL THE ENTIRE PUBLIC HAVE LEFT THE PREMISES.”
(iii) Doors to external courts and passageways which open inwards and all collapsible gates, rollers, and sliding shutters shall, while the public are on the premises be locked in the fully open position in such a way that a key is required to release them. By such doors, gates and shutters, a notice shall be erected as follows:-
“THIS GATE MUST BE KEPT OPEN AND LOCKED IN THAT POSITION WHENEVER MEMBERS OF THE PUBLIC ARE ON THE PREMISES”.
The lettering shall be to the satisfaction of the Licensing Authority.
(iv) All removable bolts, chains or padlocks and keys used for securing the entrance doors of the premises or the doors to any external courts or passageways shall be removed before the admission of the public to the premises and shall not be replaced until the public have left the premises. Such bolts, chains, padlocks and keys shall be kept where they are available only to the person in charge of the premises.
(m) The contents of any room in the premises shall be so arranged or disposed as to provide for any persons therein an unobstructed escape route to a means of escape in case of emergency;
Only such parts of the premises as have been approved by the Licensing Authority shall be used as retiring rooms or cloakrooms and provisions for hanging hats or coats shall not be made in corridors, passages, gangways or exit ways used by the public;
(n) Where necessary the nosing of steps in the premises to which the public have access shall be maintained conspicuous to the satisfaction of the Licensing Authority;
(o) The hangings or curtains over exit doors or across gangways shall be made to part in the centre to hang so as to be readily drawn aside, and not trail on the floor and be arranged so as not to conceal notices;
(p) Minimum headroom height to all exit doorways, public areas and staircases shall be as prescribed by the Building Regulation Authority and Licensing Authority;
(q) Where practicable a continuous and uninterrupted handrail shall be fixed on both sides of all staircases and landings used by the public. Where the staircase is 1.8 metres in width and upwards a central handrail shall be provided properly supported and secured to the steps. Similar handrails shall be provided on any ramp, the slope of which exceeds one in ten, and in no case shall the slope of any ramp exceed a gradient of 1 in 12.
EXIT SIGNS
11. (a) All exit doors or openings approved by the Licensing Authority shall be clearly marked in compliance with the Health and Safety (Signs and Signals) Regulations 1996.
(b) Doors and openings, other than exits which lead to portions of the premises accessible to the public shall have notices placed over them indicating the use of such portions or be marked “PRIVATE”;
(c) Such additional notices and signs indicating the way out of the premises shall be provided as the Licensing Authority may consider necessary;
(d) Notices bearing the words “NO EXIT” shall not be provided;
(e) The notices referred to in this condition shall be where practicable at a height of at least 2 metres to 2.5 metres above the floor and where possible shall be placed over the doors in openings to which they relate;
(f) All new and replacement signs shall comply with the Health and Safety (Signs and Signals) Regulations 1996 and be uniform throughout the premises.
SEATING AND GANGWAYS
12. The seating and gangway arrangements within the premises shall be to the satisfaction of the Licensing Authority in accordance with approved seating plans.
Facilities for disabled persons shall be to the satisfaction of the Licensing Authority.
CEILINGS
13. (a) The Licensee shall report to the Licensing Authority whenever it is proposed to redecorate or erect scaffolding in the public part of the premises and shall then arrange for the ceiling of such part of the premises to be examined on his behalf by a competent technical adviser. The Licensee shall notify the Licensing Authority of the examination and shall permit a technical officer on behalf of the Licensing Authority to be present to ensure that such examination is as thorough as circumstances will allow;
(b) If redecoration does not take place within five years from the date of the last inspection of the ceiling of the premises or if the Licensing Authority shall at any time so require, a special inspection and examination of such ceiling shall be carried out on behalf of the Licensee by a competent technical adviser. The Licensee shall notify the Licensing Authority of the examination and shall permit a technical officer on behalf of the Licensing Authority to be present for the purpose aforesaid;
(c) The fact that an inspection has been carried out in the presence of a technical officer representing the Licensing Authority will not relieve the Licensee of his primary responsibility for the safety of the premises;
(d) Whenever any such inspection and examination is carried out a certificate in the form prescribed by the Licensing Authority shall be furnished by the Licensee to the Licensing Authority;
(e) When redecoration is undertaken all ceiling surfaces and linings shall be specially treated to achieve a minimum of Class “1” resistance to surface spread of flame unless otherwise specified;
(f) When practicable adequate access shall be provided and maintained to the satisfaction of the Licensing Authority to the roof voids above the public parts of the premises for the purpose of inspection;
TOILETS
14. (a) Adequate and separate toilet and washing facilities shall be provided for persons of each sex to the satisfaction of the Licensing Authority;
(b) All water closets and urinals shall at all times be kept in good working order and repair and be properly and effectively cleaned, ventilated, disinfected and supplied with water;
(c) The position of toilets for each sex shall be clearly indicated.
CLOAKROOMS
15. Cloakrooms for males and females shall be provided to premises Licenced for entertainment.
HOUSEKEEPING
16. All parts of the Licenced premises shall at all times be kept thoroughly cleaned to the satisfaction of the Licensing Authority. Unnecessary combustibles shall not be allowed to accumulate on the premises.
ELECTRICAL INSTALLATIONS
17. (a) All electrical fittings, wiring and appliances shall be constructed, installed and maintained to the satisfaction of the Licensing Authority having regard to Statutory Regulations, as applicable, and taking into account the type of licence applied for, the size of the premises, permitted accommodation figures etc. Any renewal, adaptation, modification or extension, whether permanent or temporary, shall conform to the current regulations for the Electrical Equipment of Buildings, issued by the Institution of Electrical Engineers.
(b) An electrical installation inspection certificate signed by a competent person certifying that the complete installation is maintained in a safe and satisfactory condition shall be submitted to the Licensing Authority, if so required, prior to the grant or renewal of a licence. To accord with Cinematograph (Safety) Regulations 1955 certificates are required to be submitted once a year.
(c) “For the purposes described above a competent person should be one of the following:-
i. a professionally qualified Electrical Engineer.
ii. a member of the Electrical Contractors’ Association (Inc.) Limited.
iii. a certificate holder of the National Inspection Council for Electrical Installation Contracting; or
iv. a qualified person acting on behalf of one of these (In which event it should be stated for whom he is acting).”
(d) The licensee shall provide a protected supply for the use of all amplification equipment of whatever kind, and other electrical equipment used as part of the entertainment event, being fed via a residual current device which has a maximum trip current of 30 mA. The device should be in the form of a socket or integral with the main isolation device.
NORMAL OR GENERAL LIGHTING
18. All parts of the premises, including external escape routes to a place of safety, shall be provided with an adequate and permanent normal lighting system the control and installation of which shall be to the satisfaction of the Licensing Authority.
EMERGENCY LIGHTING [OR SAFETY LIGHTING UNDER CINEMATOGRAPH (SAFETY) REGULATIONS (1955)]
19. An emergency lighting or safety lighting system (in addition to the normal lighting) shall be installed in the premises to the satisfaction of the Licensing Authority. Such lighting shall be switched on (where appropriate) and be in good working order at all times when the public are present on the premises.
TEMPORARY ELECTRICAL INSTALLATION
20. (a) In premises having a stage or platform provided with a permanent installation for the lighting of the productions, arrangements shall be made for the full utilisation of such permanent installation so far as practicable before the use of additional temporarily installed equipment;
(b) Where the use of temporary installations is unavoidable for a stage play production, discotheque or any other specified function, such wiring or equipment shall be under the control of a competent person who shall ensure the following:-
i. Safe erection and installation within the appropriate requirements relating to temporary installations specified in the current edition of the Regulations for the Electrical Equipment of Buildings issued by the Institution of Electrical Engineers;
ii. Safe use;
iii. Disconnection and removal after use;
iv. Display of the name of the competent person and designation at the point of connection or control.
(c) Special conditions apply to the safe use of lasers and other special effects and these are outlined in a Guidance Note available on request from the Director of Finance and Environmental Health.
FAILURE OF LIGHTING
21. If there is a failure of electric lighting (normal or emergency) the public shall be instructed to leave the premises by the end of one hour of continued failure.
SHOWCASES
22. Electrical wiring or apparatus shall not be installed in showcases containing readily combustible materials.
STAGE LIGHTING
23. All stage lighting equipment shall be so installed and erected so as to prevent contact with scenery or other combustible materials.
LAMP-HOLDERS
24. All lamp holders shall be kept fitted with lamps.
GAS INSTALLATION
25. (a) Any gas installation shall comply with the then current Gas (Safety) Regulations;
(b) The gas installation shall be inspected and tested annually by a CORGI registered contractor or equivalent. The results and findings of the inspecting engineer should be listed on the Council’s Gas Installation Inspection Report.
HEATING INSTALLATION
26. (a) Heating installation shall comply with current statutory regulations and codes of practice;
(b) All heaters shall be permanently fixed in position and shall be fitted with appropriate protective guards;
(c) Heaters of a portable type shall not be used;
(d) Portable Liquefied Petroleum gas bottles or cylinders shall not be permitted within the premises. Bulk supply installations shall be installed in strict compliance with current codes of practice;
(e) All open fireplaces or stoves shall be properly protected.
VENTILATION
27. Adequate ventilation to all parts of the premises shall be provided to the satisfaction of the Licensing Authority.
FIRE ALARM SYSTEM
28. Where deemed necessary an adequate fire alarm system shall be provided to the satisfaction of the Licensing Authority, in accordance with the current British Standard. The system shall be in good working order at all times when the public are present on the premises.
REPORTS OF OUTBREAKS OF FIRE
29. (a) All outbreaks of fire or suspected outbreaks shall be immediately reported to the Fire and Rescue Service;
(b) At all times when the public are present it shall be the specific duty of at least one responsible person to call the Fire and Rescue Service in case of fire or any suspected fire. Such person(s) should know the location of the nearest telephone and the nearest alternative telephone and be familiar with the emergency method of calling the Service;
(c) A notice shall be kept on the premises giving instructions concerning the quickest available method of calling the Service.
FIRE EQUIPMENT
30. Fire fighting equipment shall be provided and maintained to the satisfaction of the Licensing Authority. All fire extinguishers shall be mounted in a manner approved by the Licensing Authority. Arrangements shall be made whereby the fire equipment receives regular annual inspection and maintenance by a competent person in accordance with the current code of practice. The date of such tests should be clearly marked on the equipment or on stout tabs attached thereto.
WATER SUPPLY
31. The Licensee shall notify the Licensing Authority immediately if the water supply to the hydrant, hose reel, sprinkler, drencher or other fire extinguisher installation is cut off or restricted.
ACCESS FOR FIRE AND RESCUE SERVICE
32. Adequate access for Fire and Rescue Service vehicles and equipment should be provided and maintained at all times.
TRAINING AND INSTRUCTION IN CASE OF FIRE
33. All persons employed to work in the premises shall be given instruction and training in the procedure to adopt in case of fire and specific details of this shall be recorded in the log book. The instruction and training shall include the following:-
(a) Written information shall be made readily available to all staff;
(b) All members of staff shall receive instruction and training appropriate to their particular responsibilities in the event of an emergency;
(c) Exercises for the staff only shall be held regularly to ensure the efficient operation of the procedure for dealing with an emergency.
LOG BOOK
34. Where required by the Licensing Authority a suitable log book, which shall be produced on request to any of the persons mentioned in Condition 44, shall be provided and signed by the Licensee weekly, in which shall be recorded:-
(a) Record of fire drills;
(b) Any failure of or in the normal, emergency or safety lighting system and the action taken;
(c) Any outbreak of fire.
FURNISHINGS AND UPHOLSTERY COVERINGS
35. All new or replacement materials used for upholstery shall be suitably treated for flameproofing to British Standard 5852: Part 1 1979 and Part 2 1982 and evidence of such treatment shall be provided as appropriate.
SCENERY DECORATIONS
36. All scenery or decorations shall be of either inherently flame retardant material or be rendered so and maintained in that condition. Highly flammable and readily ignitable materials such as paper, celluloid and cotton wool shall not be used.
REAL FLAME DANGEROUS MATERIALS AND EFFECTS
37. (a) Naked flame or lights, flash powder, explosives or highly flammable materials shall not be used in any performance except with prior notification to the Licensing Authority;
(b) Such materials shall be used only when essential to the action as distinct from the atmosphere of the performance;
(c) Special conditions apply to the use of certain special effects and these are outlined in a Guidance Note available on request from the Director of Finance and Environmental Health.
FLAMMABLE MATERIALS AND LITTER
38. All dirt, rubbish or flammable waste material shall be kept in suitable containers which shall be kept outside the premises or in a place within the premises approved by the Licensing Authority. Storage of equipment shall be permitted in parts of the premises authorised by the Licensing Authority.
Metal containers with fitted lids shall be provided in all dressing rooms for the reception of litter and waste.
SMOKING
39. Smoking shall be strictly prohibited in any stage and dressing room area and notices to this effect shall be prominently displayed in suitable places.
Smoking shall be strictly prohibited on any stage except where it is necessary in connection with the performance. Notices to this effect shall be prominently displayed in suitable places.
PUBLIC NUISANCE
40. The Licensee shall not use the premises so as to cause or be a nuisance or annoyance. This includes noise from amplified music etc. from within the premises.
STRUCTURAL AND ELECTRICAL ALTERATIONS
41. Alterations or additions whether permanent or temporary to the structure, the lighting, heating or ventilation installations or to the seating, gangways or other arrangements at the premises shall not be made except with the prior approval of the Licensing Authority. Copies of the plans of the proposed alterations or additions shall be deposited with the Licensing Authority, Fire and Rescue Service and Lancashire Constabulary. In new or altered works to Licenced premises where Building Regulations apply premises should be completed to the full Building Regulation Standards.
SUPERVISION OF CHILDREN
42. In premises where children and parents are likely to be separated or use different floors, the Licensing Authority shall be informed.
DISABLED PERSONS
43 . Arrangements for the admission of disabled persons to the premises shall be made and maintained to the satisfaction of the Licensing Authority.
ENTRY AND INSPECTION
44. Any authorised officer of the Licensing Authority or the Fire and Rescue Service may at any reasonable time enter and inspect the premises in respect of which a licence is in force for the purpose of ensuring that the terms, restrictions and conditions on or subject to which the licence is held are being complied with.
FOOD HYGIENE
45. Where food or drink is sold for human consumption from the Licenced premises, the Licensee shall ensure that any sale, storage or preparation of foods or drink is in accordance with good hygienic catering practice, to the satisfaction of the Licensing Authority and that the requirements of the Food Safety Act 1990 and all associated regulations are complied with at all times.
RESPONSIBILITIES FOR SAFETY ETC
46. The Licensee shall take all reasonable precautions for the safety of the public, performers and employees and shall comply in all respects with the provisions of the Health and Safety at Work Act 1974 and any relevant regulations made thereunder.
PART 3 ADDITIONAL CONDITIONS FOR PREMISES USED FOR STAGE PRESENTATIONS
GENERAL
1. These conditions shall be read in conjunction with Part 2 Conditions.
SAFETY CURTAIN
2. (a) In premises where a safety curtain is fitted to the proscenium opening, it shall be clearly marked as such on the auditorium side and shall be lowered at least once during each performance in the presence of the audience;
(b) In the event of the safety curtain being out of order, the Licensee shall immediately notify the Licensing Authority;
(c) No apparatus or scenery or properties or curtains or hangings shall at any time during the performance cross the plane of descent of the safety curtain and shall not in any circumstances interfere with its descent;
(d) Except with the consent of the Licensing Authority, scenery or properties shall not be placed on the auditorium side of the safety curtain.
SHUTTERS TO SCENERY STORES ETC
3. In premises where scenery stores/workrooms are provided, shutters, to openings for the passage of scenery between the stage and such stores or workrooms shall be kept closed when the public are on the premises.
STAGE LANTERN
4. In premises where a stage lantern is provided the sashes and other moving parts of the lantern light over the stage shall be tested periodically to ensure that they are in efficient working order. There shall be no obstruction to the upward flow of air from the stage to the ventilators and the release lines and other controlling gear shall be kept readily accessible and secured in such a manner as to permit of their immediate release. The notices indicating the release lines shall not be obscured. Some spare fusible links shall be kept in reserve. The result of each test required by this rule and a statement that the arrangements are in accordance with this rule shall be recorded in the log book.
FIREMAN
5. If required by the Licensing Authority a competent person shall be in charge of fire precautions during the whole time the premises are open to the public. He shall have no duties that will prevent him from being immediately available in the event of a fire and he shall be responsible for the following duties:-
(a) To check the fire equipment before the public enter the premises;
(b) To be ready to use the equipment quickly and efficiently;
(c) To see that exits and exit routes are kept free from obstruction.
NOTICE TO LICENSING AUTHORITY
6. Where an annual licence is in being at least fourteen days notice in writing shall be given to the Licensing Authority specifying the date on which a new production will begin to be presented.
STORAGE OF SCENERY ETC
7. Scenery or properties, other than those required for use in current productions shall be stored only in positions approved by the Licensing Authority.
SUSPENSION OF SCENERY
8. All ropes or other means employed for the suspension of scenery, etc. together with associated pulleys, winches, etc. shall be regularly checked by a competent person appointed by the Licensee at such intervals as may be deemed necessary by the Licensing Authority.
PART 4 - OUTDOOR LICENSING CONDITIONS
SAFETY OF ALL PERSONS
1. The Licensee shall be responsible for the provision of such safety measures as the Licensing Authority may deem necessary to secure the safety of performers and all other persons present at the entertainment.
ACCESS FOR EMERGENCY VEHICLES
2. The Licensee shall secure adequate access for all emergency vehicles to, on and around the site of the entertainment as deemed necessary by the Licensing Authority.
SANITARY ARRANGEMENTS
3. The Licensee shall provide adequate sanitary appliances and provisions as deemed necessary by the Licensing Authority.
PUBLIC NUISANCE
4. The entertainment provided under the licence shall be controlled so that no annoyance or nuisance is caused.
ADDITIONAL CONDITIONS FOR PREMISES USED FOR CINEMA
EXHIBITIONS
GENERAL
1. These conditions shall be read in conjunction with Part 2 Conditions.
STATUTORY CONDITIONS
2. Attention is drawn to the need to comply with Current Regulations made by the Secretary of State under the Cinemas Act 1985.
FILM
3. No film shall be exhibited unless:-
(a) It has received a “U”, “PG”, “12”, “15” or “18” Certificate of the British Board of Film Classification;
or
(b) It is a current newsreel which has not been submitted to the British Board of Film Classification.
“18” FILMS
4. No person apparently under the age of 18 years shall be admitted to any exhibition at which there is to be shown any film which has received an “18” Certificate from the British Board of Film Classification.
“15” FILMS
5. No person apparently under the age of 15 years shall be admitted to any exhibition at which there is to be shown any film which has received a “15 Certificate from the British Board of Film Classification.
“12” FILMS
6. No person apparently under the age of 12 years shall be admitted to any exhibition at which there is to be shown any film which has received a “12” Certificate from the British Board of Film Classification.
PERMISSION OF LICENSING AUTHORITY
7. Notwithstanding the conditions herein before contained, a film may be exhibited or persons of any class of persons may be admitted thereto if the permission of the Licensing Authority is first obtained and any conditions of such permission are complied with.
FILM CENSORS CERTIFICATE TO BE SHOWN
8. A representation or written statement of the terms of any Certificate given by the British Board of Film Classification shall be shown on the screen immediately before the film . Also the representation or statement shall be shown for long enough and in a form large enough for it to be read from any seat in the auditorium.
NOTICE OF FILM CLASSIFICATION AND TIMES OF SHOWING
9. There shall be prominently exhibited at each public entrance whenever the premises are open to the public a notice indicating in tabular form and in clear bold letters and figures:-
(a) The title of each film to be shown on that day, other than trailers and films of less than five minutes duration;
(b) The approximate times of commencement of each such film;
(c) Whether each such film has received a “U”, “PG”, “12”, “15” or “18” Certificate from the British Board of Film Classification.
and
(d) The effect of such “U”, “PG”, “12”, “15” or “18” Certificates in relation to the admission of persons under the age of 18 years.
ADVERTISEMENTS TO INDICATE NATURE OF CERTIFICATE
10. The nature of any Certificate received in respect of a film from the British Board of Film Classification shall be clearly indicated by the figure “U”, “PG”, “12”, “15” or “18” in any advertisement of the film displayed at the premises.
RESTRICTION IN ADVERTISEMENT
11. No advertisement displayed at the premises of a film to be exhibited at the premises shall depict as a scene or incident in the film any scene or incident which is not included in the film as certified by the British Board of Film Classification or approved for exhibition by the Licensing Authority, as the case may be.
LICENSING AUTHORITY MAY OBJECT TO ADVERTISEMENTS
12. Where the Licensing Authority has given notice in writing to the Licensee of the premises objecting to an advertisement on the grounds, that, if displayed, it would offend against good taste or decency or be likely to encourage or incite to crime or to lead to disorder or to be offensive to public feeling that advertisement shall not be displayed at the premises except with the consent in writing of the Licensing Authority.
LICENSING AUTHORITY MAY PROHIBIT FILMS
13. Where the Licensing Authority has given notice in writing to the Licensee of the premises prohibiting the exhibition of a film on the grounds that it contains matter which, if exhibited, would offend against good taste or decency or would be likely to encourage or incite to crime or to lead to disorder or to be offensive to public feeling, that film shall not be exhibited in the premises except with the consent in writing of the Licensing Authority.
DEFINITION OF “FILM”
14. For the purposes of this Licence “film” means any exhibition of moving pictures produced otherwise than by the simultaneous reception and exhibition of television programmes broadcast by the British Broadcasting Corporation or the Independent Broadcasting Authority or distributed by a system Licenced by the Secretary of State under Section 89 of the Post Office Act 1969.
EXHIBITION OF FILM TO LICENSING AUTHORITY
15. If the Licensing Authority request the Licensee to exhibit to them any film he shall do so at such reasonable time as the Licensing Authority may in writing direct.
ALTERATION OF FILM CATEGORY BY LICENSING AUTHORITY
16. If the Licensing Authority do not agree with the category in which any film passed by the British Board of Film Classification is placed, they shall be at liberty to alter such category and on notice of such alteration being given by the Licensing Authority to the Licensee, the film thereafter shall be treated as having been placed in the altered category and the condition applicable to the exhibition of films in such altered category shall be complied with.
WASTE FILM
17. A metal box with a self closing close fitting lid suitable for waste film shall be provided in the rewind room and shall be used for no other purpose than for waste film and shall be emptied daily.
INFLAMMABLE FILMS
18. No inflammable cinematograph films shall be carried or conveyed through any part of the building whilst the public are thereon unless the same are carried or conveyed in closed metal boxes.
STAFF INSTRUCTION
19. The persons referred to in Regulation 5(3) of the Cinematograph (Safety) Regulations 1955 shall receive instruction in accordance with the Regulation at least once in every twelve months and at least one such person in addition to the person in charge shall be present on duty at all times when the public are on the premises and shall be immediately available in the event of danger or an alarm of fire.
ATTENDANTS IDENTIFICATION
20. All the attendants referred to in Regulation 4(3) of the Cinematograph (Safety) Regulations 1955 shall wear either distinctive clothing or suitable arm bands or other adequate distinguishing mark.
WAITING SPACES
21. Persons awaiting admission to the premises shall not be allowed to congregate in any portion of the premises except in positions approved by the Licensing Authority in writing for this purpose.
QUEUES
22. In cases in which persons wait in queues for admission the Licensee shall do what is reasonably necessary to prevent such person so waiting from obstructing exits, external courts, passageways, stairways and ramps leading to the outside of the Licenced premises.
STANDING
23. Where the Licensing Authority sanctions standing in pursuance of Regulation 3(4)a of the Cinematograph (Safety) Regulations 1955 the area in which such standing is permitted shall be marked with (a conspicuous white line) together with (or) (a conspicuous notice indicating the number of persons permitted to stand in that area).
CHILDREN
24. Where an entertainment organised wholly or mainly for children is provided no child shall be permitted to be in the front row of seating on any floor of the auditorium above the lowest floor unless accompanied by and in the charge of a person who has attained the age of sixteen years.
