ANNEX 2 - CONDITIONS IMPOSED IN ACCORDANCE WITH THE OPERATING SCHEDULE & UNDER PARAGRAPH 18(4) & 18(5) SCHEDULE 8 LICENSING ACT 2003
The premises shall be operated as a bona fide qualifying club licensable activities being confined to members of the club and a member's guests only
There shall be no admission or re-admission to members and their guests after midnight
Alcohol shall not be sold or supplied except during permitted hours. The above restriction does not apply to the supply to, or consumption by, any person of alcohol in any premises where they are residing.
Where there is an entertainment for children or an entertainment at which the majority of the persons attending are children, then if the number of children attending the entertainment exceeds 100 it shall be the duty of the person providing the entertainment to station and keep stationed wherever necessary a sufficient number of adult attendants, properly instructed as to their duties, to prevent more children or other persons being admitted to the building, or part thereof, than the building or part can properly accommodate, and to control the movement of the children and other persons admitted while entering and leaving the building or an part thereof, and to take all reasonable precautions for the safety of the children.
The premises licence holder or club premises certificate holder when permitting for hire or reward, the building to be used for the purpose of an entertainment, shall take all reasonable steps to ensure the observance of the provision of the above provision
No person under the age of 16 years and no child aged 16 years shall take part in any performance to which Section 37 (2) of the Children and Young Persons Act 1963 applies, and in which his life or limbs are endangered.
The licence holder and/or the designated premises supervisor or a person nominated by them shall be a member of and regularly attend at the meetings of the Pub and Club Watch schemes for the area within which the premises is located.
A CCTV system shall be operated at the premises to the satisfaction of Lancashire Constabulary
The Premises licence holder and the designated premises supervisor shall at all times comply with the Portman Group Code of Practice and with the requirements or recommendations of any Portman Group Retailer Alert Bulletin
There shall be no irresponsible drinks promotions which would contravene the British Beer and Pub Association Code of Practice on Point of Sales Promotions
All staff concerned with alcohol sales shall be trained to prevent under age sales
The maximum capacity of the first floor concert room shall be 120 persons including staff and entertainers
All exits at Annex 4 and escape routes to those exits (including external escape routes) from the premises shall be maintained in good repair, correct working order and kept free from all obstructions and shall be available for immediate use when the public are on the premises.
Before the premises are opened for the purposes authorised by the licence an inspection shall be carried out to ensure that the premises are safe for use. Details of the inspection, defects discovered and remedial action taken shall be recorded in writing in a logbook kept for that purpose. That logbook shall be made available for inspection on demand to an Authorised Officer of the Council, a Fire Officer or a Police Constable.
There shall be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials.
Duty staff shall summon the Fire and Rescue service when necessary
There shall be inspection of the Gas, Electric Emergency Lighting and Fire alarm by a qualified engineer annually or at such period within 5 years as required or recommended under current Regulation or British Standard
When disabled persons are present on the premises there shall be in place arrangements for their safe evacuation in the case of an emergency or other reason. Details of those arrangements shall be recorded in writing and all staff employed on the premises shall be aware of those arrangements.
No portable electrical equipment used in connection with regulated entertainment shall be connected to the mains electrical circuit except via a residual current detection device unless the mains circuit is isolated from the lighting and emergency lighting circuits by means of a circuit breaker at the distribution board
All external doors and windows shall be kept closed when regulated entertainment is being provided except in the event of an emergency or to facilitate immediate access or egress.
There shall be placed at all exits from the premises in a place where they can be seen and easily read by members and their guests, notices requiring customers to leave the premises and the area quietly.
The grounds of the premises shall be kept tidy and their condition shall not be the cause of public nuisance
No person under the age of 18 years shall be allowed to enter or remain on the premises after 1800 hours unless attending a function in the function room for one or more members and their guests to which the general membership of the club and their guests are not invited.
Any Section 31 or 34(5)(e) Gaming Act 1968 or Category B or C Gambling Act 2005 machine shall be sited within view of the bar or servery
