ANNEX 2 - CONDITIONS IMPOSED IN ACCORDANCE WITH THE OPERATING SCHEDULE & UNDER PARAGRAPH 18(4) & 18(5) SCHEDULE 8 LICENSING ACT 2003
The premises shall be operated as a bona fide qualifying club licensable activities being confined to members of the club and a member's guests only
Alcohol shall not be sold or supplied except during permitted hours. The above restriction does not apply to the supply to, or consumption by, any person of alcohol in any premises where they are residing.
Where there is an entertainment for children or an entertainment at which the majority of the persons attending are children, then if the number of children attending the entertainment exceeds 100 it shall be the duty of the person providing the entertainment to station and keep stationed wherever necessary a sufficient number of adult attendants, properly instructed as to their duties, to prevent more children or other persons being admitted to the building, or part thereof, than the building or part can properly accommodate, and to control the movement of the children and other persons admitted while entering and leaving the building or an part thereof, and to take all reasonable precautions for the safety of the children.
The premises licence holder or club premises certificate holder when permitting for hire or reward, the building to be used for the purpose of an entertainment, shall take all reasonable steps to ensure the observance of the provision of the above provision
No person under the age of 16 years and no child aged 16 years shall take part in any performance to which Section 37 (2) of the Children and Young Persons Act 1963 applies, and in which his life or limbs are endangered.
Any Section 34(5)(e) Gaming Act 1968 or Category B or C Gambling Act 2005 machine shall be sited within view of the bar servery
All members of the management shall be trained to promote the licensing objectives
A CCTV system shall be operated at the premises in liaison with and to the satisfaction of Lancashire Constabulary
There shall be a computerised door entry system to the premises
Persons who appear to be under the age of 21 years shall be required to produce proof of age by way of one of the following:
- A recognised proof of age card accredited under the British Retail Consortiums Proof of Age Standards Scheme (PASS)
- Photo driving licence
- Passport
- Citizen card supported by the Home Office
- Official ID card issued by HM Forces or European Union bearing a photograph and birth of the holder
Before the premises are opened for the purposes authorised by the licence an inspection shall be carried out to ensure that the premises are safe for use. Details of the inspection, defects discovered and remedial action taken shall be recorded in writing in a logbook kept for that purpose. That logbook shall be made available for inspection on demand to an Authorised Officer of the Council, a Fire Officer or a Police Constable.
There shall be annual inspection of the Gas, Electric Emergency Lighting and Fire alarm annually by a qualified engineer
All exits at Annex 4 and escape routes to those exits (including external escape routes) from the premises shall be maintained in good repair, correct working order and kept free from all obstructions and shall be available for immediate use when the public are on the premises.
There shall be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials.
Notices shall be prominently displayed in the premises detailing the essential steps that must be taken if a fire is discovered or the fire alarm goes off or other emergency arises and how to call the Fire Service.
No portable electrical equipment used in connection with regulated entertainment shall be connected to the mains electrical circuit except via a residual current detection device unless the mains circuit is isolated from the lighting and emergency lighting circuits by means of a circuit breaker at the distribution board
There shall be placed at all exits from the premises in a place where they can be seen and easily read by members and their guests notices requiring customers to leave the premises and the area quietly.
The licence holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents
No nuisance shall be caused by noise coming from the premises or by vibration transmitted through the structure of the premises to noise sensitive premises in the vicinity
No person under the age of 18 years shall be allowed to enter or remain on the premises unless accompanied by a member or guest of a member who is at least 18 years of age.
No person under the age of 18 years shall be permitted to enter or remain on the premises unless attending a function in the concert room except on a Sunday.
No person aged between 8 and 18 years shall be permitted to enter or remain on the premises on a Sunday unless between 1200 hours and 1800 hours.
No person shall be allowed to become a member of the club unless they are at least 18 years of age
A notice or notices shall be displayed in and at the entrance to the premises where they can be clearly seen and read and shall indicate that it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.
