• ANNEX  1

   

  Alcohol shall not be sold or supplied except during permitted hours. In this condition, permitted hours mean:

   

  a. On weekdays, other than Christmas Day, 8 a.m. to 11 p.m.

  b. On Sundays, other than Christmas Day, 10 a.m. to 10.30 p.m.

  c. On Christmas Day, 12 noon to 3 p.m. and 7 p.m. to 10.30 p.m.

  d. On Good Friday, 8 a.m. to 10.30 p.m.

   

  The above restrictions do not prohibit:

   

  (a) during the first twenty minutes after the above hours, the taking of the alcohol     from the premises, unless the alcohol is supplied or taken in an open vessel;

   

  (b) the ordering of alcohol to be consumed off the premises, or the despatch by the    vendor of the alcohol so ordered;

   

  (c) the sale of alcohol to a trader or club for the purposes of the trade or club;

   

  (d) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;

   

  No supply of alcohol may be made under the premises licence -

   

  (a) at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Alcohol shall not be sold in an open container or be consumed in licensed premises

   

  Licensing Act 2003 Mandatory conditions where licence authorises the supply of alcohol

   

  (1) No supply of alcohol may be made under the premises licence -

   

  (a) at a time when there is no designated premises supervisor in respect               of the          premises licence, or

   

  (b) at a time when the designated premises supervisor does not hold a personal  licence or his personal licence is suspended.

   

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

• ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

  The prevention of crime and disorder

   

  (i)              A CCTV system shall be installed, maintained and operated at the premises to the satisfaction of Lancashire Constabulary and shall be used to record during all hours that the premises are open to the public.

   

  (ii)              The images recorded by the CCTV system shall be retained and images from the system shall be given to Lancashire Constabulary or the Licensing

  Authority upon demand.

   

  iii)              The premises must have panic buttons fitted.

   

  (iv)              The staff  must use counter cache boxes which are emptied regularly.

   

  Public safety

   

  (i)              up to date fire equipment must be installed

   

  (ii)              There must be  a rear fire exit at the premises

   

  The prevention of public nuisance

   

  (i)              Young person  should not be permitted to loiter outside the Premises and  in the shop they are only allowed in  2 at a time.

   

  The protection of children from harm

   

  (i)              A notice or notices shall be displayed in and at the entrance to the premises where they can be clearly seen and read and shall indicate that it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.

   

  (ii)              All staff shall receive training to prevent under age sales of alcohol.

   

  (iii)              Persons who appear to be under the age of 25 years shall be required to produce proof of age by way of one of the following:

   

  a.              A recognised proof of age card accredited under the British Retail Consortiums Proof of Age Standards Scheme.

  b.              Photo driving licence

  c.              Passport

  d.              Citizen card supported by the Home Office

  e.              Official ID card issued by HM Forces or European Union Member State bearing a photograph and birth date of the holder.

   

  (iv)              A refusals book shall be maintained to record all challenges and refused sales to persons who cannot comply with the above conditions.
