ANNEX 2 - CONDITIONS CONSISTENT WITH OPERATING SCHEDULE
Upon commencement of their employment, all staff who are involved in the sale of alcohol will be trained in relation to the licensing objectives so as to reduce crime and disorder, promote public safety. prevent public nuisance and promote the protection of children from harm. The training will cover matters including but not limited to the premises licence, proxy sales, underage sales, vulnerability, sales to intoxicated customers, drugs, conflict management and basic first aid. Refresher training will be provided at least once every twelve months and all training will be documented and made available to an authorised officer upon request.
The premises will be an active member of any local "pub watch" or equivalent scheme where such a scheme is in existence, and will have a representative at each meeting they are notified of, unless otherwise communicated in advance to a representative of Lancashire Constabulary's Licensing Unit.
The premises will have a written dispersal policy which is enforced at all times and which has been approved by a representative of Lancashire Constabulary's Licensing Unit, such approval not to be unreasonably withheld. Said policy will cover matters including but not limited to the tempo of music in the period leading up to closure; lighting in the period leading up to closure; the timing of last orders and drinking up time; signage; weapons risks; supervision; and, the control of external areas and dispersal away from the premises and the vicinity.
In the event that the Designated Premises Supervisor is not present and the premises is open to the general public, another personal licence holder will be appointed to manage the premises. Said appointment will be made in writing so that there is no confusion as to who has control of the premises at any given time.
The prevention of crime and disorder
A CCTV system shall be installed internally and externally at the premises and will meet the following criteria:-
- The system will display on any recording the time and date of said recording;
- The system will be recording whenever the premises is open to the public;
- Any recordings will be retained for a minimum of 31 days after they are made and will be produced to an authorised officer upon request, so long as said request is in accordance with the principles of the Data Protection Act or any
subsequent or alternative legislation;
- The CCTV will capture all public areas of the premises (with the exception of the toilets), and will capture the area immediately to the front of the premises.
Appropriate signage altering customers to the use of CCTV shall be displayed in conspicuous positions at the premises.
A competent person trained in the use of and operation of the CCTV will be in attendance at the premises at all times that licensable activities are taking place. Said person will be able to fully operate the CCTV system and be able to download data in a recognised format when requested.
An incident register of any occurrences or ejections from the premises will be maintained at the premises and details of any public order offences will be recorded. Said register will be retained for a minimum of twelve months, and will be made available upon request to an authorised officer.
Prior to any occasion on which licensable activities are to be carried on at the premises, a risk assessment will be carried out to determine whether door supervisors are required. An appropriate number of door supervisors will be utilised in accordance with said risk assessment, which will be documented, retained for a minimum of twelve months, and made available to an authorised officer upon request.
As a minimum, there will be at least four door supervisors on duty from 22:00 or the time that the premises opens to the general public on Fridays, Saturdayss, Sundays which immediately precede a bank holiday Monday, Christmas Eve, Boxing Day and New Year's Eve. Door supervisors will remain on duty until there are fewer than twenty-five customers remaining in or in the immediate vicinity of the premises. A minimum of two door supervisors will remain on duty until at least thirty minutes after the last customers have exited the premises or until there are fewer than ten customers remaining in or in the immediate vicinity of the premises (whichever is sooner).
The Designated Premises Supervisor or in his/her absence the person in charge of the premises shall keep and maintain a door supervisor logbook, showing in respect of each period of duty of that door supervisor:
(i) His or her full name and SIA badge number;
(ii) the time at which he or she commenced that period of duty with a signed acknowledgement by that person;
(iii) the time at which he or she finished the period of duty with a signed acknowledgement by that person;
(iv) any times during the period of duty when he or she was not on duty; and,
(v) if the door supervisor is not an employee of the Designated Premises Supervisor or his or her employer, the full name of the person by whom the door supervisor is employed or through whom the services of that person were engaged.
Door supervisors will required to wear high visibility clothing that clearly identifies them as door supervisors.
The premises will have a written search policy which is enforced at all times and which has been approved by a representative of Lancashire Constabulary's Licensing Unit, such approval not to be unreasonably withheld.
The premises will have a written drugs policy which is enforced at all times and which has been approved by a representative of Lancashire Constabulary's Licensing Unit, such approval not to be unreasonably withheld. Said policy will cover matters including signage, confiscation, reporting and storage.
Public safety
No drinks will be served to customers in standard glass receptacles. Only toughened glass, polycarbonate, plastic or another alternative to glass will be utilised.
Staff and, when on duty, door supervisors will use their best endeavours to ensure that no drinks are taken from the premises by customers.
Signage will be displayed in prominent positions at the premises to the effect that customers are not permitted to take drinks outside.
When on duty, door supervisors will refuse acess to potential customers who present as intoxicated on their arrival to the premises.
The prevention of public nuisance
The management of the premises will ensure that the area immediately outside the entrance to the premises is kept clean, tidy and free from litter.
On any occasion that regulated entertainment is carried on at the premises, regular assessments of the noise emanating from the premises will be undertaken. Wherever said assessments indicate that noise is likely to cause nuisance to any local resident, remedial action will be taken.
The premise will have a written policy for smokers which is enforced at all times and which has been approved by a representative of Lancashire Constabulary's Licensing Unit, such approval not to be unreasonably withheld. Said policy will cover matters including: the location of smokers; delineation of a smoking area; the supervision; and, the readmission of smokers (where applicable).
Notices will be placed in a prominent position at public exits requesting that customers leave the premises and the area quietly.
Protection of children from harm
There shall be no customers under the age of 18 permitted on the premises when it is open to the general public.
A "Challenge 25" Policy shall be adopted and enforced at the premises whereby any person who appears to be under the age of 25 shall be required to provide identification to prove that they are over the age of 18 before they are permitted to purchase alcohol. The only forms of acceptable identification will be:
- A Passport;
- A UK Photocard Driving Licence;
- Official ID card issued by HM Forces or EU bearing a photograph and the date of birth of the holder;
- Any other form of identification agreed with a representative of Lancashire Constabulary's Licensing Unit.
All staff who are involved in the sale of alcohol will be trained in relation to the "Challenge 25" policy upon the commencement of their employment, following which they will undertake refresher training at least once every twelve months. Said training will be documented and will be made available to an authorised officer upon request.
The premises will maintain a refusals register which records any refusal of service and the reason for it. Where applicable, the register will be maintained both at the entrance to the premises and at the point of sale of alcohol. Said register will be documented, retained for a minimum of 12 months, and made available to an authorised officer upon request.
