Conditions Consistent with the Operating Schedule
The licence holder shall ensure that at all times when the premises is being used for licensable activity, there are sufficient competent staff on duty at the premises for the purposes of fulfilling the obligations under the Licensing Act 2003.
Upon commencement of their employment, all staff who are involved in the sale of alcohol must be trained in relation to the licensing objectives so as to reduce crime and disorder, promote public safety, prevent public nuisance and promote the protection of children from harm. Refresher training must be provided at least once every six months and all training must be documented and made available to an authorised officer upon request.
A comprehensive CCTV system must be installed internally and externally at the premises and must meet the following criteria:
The system must display on any recordings the time and date of said recording;
The system must be recording whenever the premises is open to the public;
Any recordings must be retained for a minimum of 31 days after they are made and must be produced to an authorised officer upon request, so long as said request is in accordance with the principles of the Data Protection Act or any subsequent or alternative legislation;
As a minimum, the CCTV will capture ''head and shoulders'' image of persons entering the premises through the main public entrance and cover all entry and exit points both inside and out.
Cameras viewing till areas must capture frames of not less than 50%
Cameras overlooking the floor area must be wide angled to give an overview of the premises
Cameras must provide good quality colour images when the premises is open to the public and the images must be visually capable of identifying the nature of any crime being committed.
The system should operate under existing light levels within and outside the premises.
The recording device must be located in a secure area or locked cabinet
A monitor should be available to review images and recorded picture quality
The system must be regularly maintained to ensure continuous quality of picture retention
Appropriate signage alerting customers to the use of CCTV must be displayed in a conspicuous position at the premises.
A competent person trained in the use of and operation of the CCTV system must be in attendance at the premises at all times that licensable activities are taking place. Said person must be available to fully operate the CCTV system and be able to download data in a recognised format when requested.
An incident register of all occurrences and ejections form the premises must be maintained at the premises and any details of public order offences must be recorded. Said register must be made available upon request to an authorised officer.
Any incidents of a criminal nature must be reported to the police
A 'Challenge 25' Policy must be adopted and enforced at the premises whereby any person who appears to be under the age of 25 years shall be required to produce proof of age by way of the following:
A recognised proof of age card accredited under the British Retail Consortium Proof of Age Standards Scheme (PASS)
UK Photo driving licence
Passport
Citizen card supported by the Home Office
Official ID card issued by HM Forces or European Union Member State bearing a photograph and birth date of the holder.
All staff involved in the sale, supply or provision of alcohol must be trained in relation to the 'Challenge 25' Policy upon commencement of their employment, following which they must take refresher training at least once every 12 months. Said training must be documented and made available to an authorised officer upon request.
A register of refusals must be kept on the premises at all times and must be made available for inspection upon the request of an authorised officer or police officer.
'Challenge 25' posters must be displayed and must be visible at the entrance to the premises and from the point of sale of alcohol.
All emergency exits must be kept clear of obstruction at all times.
When alcohol is ordered for delivery all refusals must be recorded and made available to an authorised officer upon request.
In the event of unrecognised or replica identification being offered the sale will be refused
In the event of a person appearing to be intoxicated when a delivery is attempted the goods will not be left and a refusal will be recorded.
Delivery staff will be trained to refuse the sale if there appears to be a house party going on with loud music and flashing lights which could be causing a nuisance to neighbours.
Delivery staff will be trained not to leave alcohol and to refuse the sale if it appears that minors are present.
Delivery drivers will ask for a signature for the goods which will be delivered in a sealed bag. The signature must be obtained from a person over the age of 18 and Challenge 25 conditions will prevail at all times.
Delivery drivers will not handle cash or make any sales from the delivery vehicle. All goods delivered will be pre ordered only and paid for electronically and all sales recorded. This will include the name, address and order details plus the time of order.
The webiste must have a pop up warning browsers that items on the site will only be sold to those over the age of 18.
Posters will be placed in store requesting that customers leave the area quietly and have proper regard to neighbours living in the vicinity.
All delivery staff will receive customer service training. The training will be recorded and records will be made available upon the request of an authorised officer.
All deliveries will be made in electric vehicles so as to minimise any disturbance to residents living close by.
There will be no deliveries to HMO's or approved premises where the police have advised that residents may be vulnerable (Lancashire Constabulary to advise)
Alcohol must not be delivered to properties where the residents are subject to Anti-Social Behaviour Orders as advised from time to time by Lancashire Constabulary.
